    Welcome to SecondRx.in, an online medical second opinion platform owned and operated by Windmill Healthcare Pvt. Ltd. ("SecondRx," "Company," "we," "us," or "our"). Our registered office is located at 206, Second Floor, Resource Workspaces, Ujagar Chambers, Opposite Deonar Bus depot, Chembur, Mumbai, India - 400080.

    The services of SecondRx are essentially provided to bridge the medical accessibility gap with a mission to reduce the burden of complex chronic diseases by providing expert medical second opinions. These Terms and Conditions ("Terms") govern your use of our website and mobile application (the "Platform") and the services we offer, including our "Smart Comprehensive Medical Review" and teleconsultation services (the "Services"). By accessing or using the Platform or Services, you agree to be bound by these Terms.

  2. Definitions

    • Medical Consultant: A qualified medical practitioner who provides second opinions and consultations through the Platform.
    • Platform: The SecondRx.in website and mobile application.
    • Services: The "Smart Comprehensive Medical Review," teleconsultation, and other related services provided by SecondRx.
    • User: Any individual who accesses or uses the Platform or Services.
    • User Content: Any content, including text, images, medical records, and other materials, that a User uploads to the Platform.
    • Healthcare providers- doctors, physiotherapists, and counselors

  3. User Accounts and Responsibilities

    • Account Registration: To access certain features of the Platform, you must create an account. You agree to provide accurate and complete information during registration and to keep your information updated.
    • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you believe your account has been compromised, please notify us immediately at admin@secondrx.in.
    • User Conduct: You agree to use the Platform and Services in a lawful and responsible manner. You shall not engage in any activity that may harm the Platform, SecondRx, or other users.
    • Eligibility: You represent and warrant that you are 18 years of age or older and that your use of the Platform and Services does not violate any applicable laws or regulations.

  4. Medical Consultants

    • No Endorsement: SecondRx does not endorse or guarantee the qualifications, expertise, or quality of services of any Medical Consultant on the Platform.
    • No Doctor-Patient Relationship: The interaction between you and a Medical Consultant through the Platform does not create a doctor-patient relationship.
    • Disclaimer of Liability: SecondRx is not liable for any advice, diagnosis, or treatment provided by a Medical Consultant.
    • No Prescriptions: Doctors do not issue prescriptions for medicines but provide advice on disease diagnosis and existing and potentially new treatment plans. We deliver a comprehensive medical review covering disease, diagnosis, and treatments. Patients must always consult their treating physicians for final treatment plans.

  5. Smart Comprehensive Medical Review and Information

    • Informational Purposes: The information and materials available through the Platform are for informational and educational purposes only and are not a substitute for professional medical advice.
    • No Guarantee: SecondRx makes no guarantees regarding the accuracy or completeness of the information on the Platform.
    • Third-Party Information: SecondRx is not responsible for information provided by third parties on the Platform.
    • Delivery of Report: A comprehensive medical review report will be delivered within a reasonable amount of time to the email address provided during registration.

  6. No Doctor-Patient Relationship

    • No Medical Advice: The information provided on the Platform, including any responses to your questions, does not constitute medical advice.
    • No Diagnosis or Treatment: The Platform and Services are not intended to diagnose or treat any medical condition.

  7. Fees and Payments

    • Some Services may require payment of fees. You agree to pay all applicable fees in advance. SecondRx is not liable for refunds except as expressly stated in the Refund and Cancellation Policy.

  8. Refund and Cancellation Policy

    • You may cancel or reschedule an appointment up to 24 hours before the scheduled time.
    • Cancellations made at least 8 hours before the scheduled appointment are eligible for a 100% refund of consultation fees. Convenience fees, and taxes if applicable are non-refundable.
    • Cancellations made less than 8 hours of the scheduled appointment are eligible for a 50% refund of the consultation fees only.
    • Cancellations made after the scheduled appointment time are not eligible for a refund of the any fees.
    • Cancellations initiated by Doctor or SecondRx team are eligible for a 100% refund of the consultation fee.
    • If you are accidentally overcharged, please notify SecondRx. You may claim a refund or have the overcharged amount credited to your account.

  9. User-Generated Content

    • Ownership: You retain ownership of your User Content.
    • License to SecondRx: By uploading User Content, you grant SecondRx a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content for the purpose of providing and improving the Services.
    • Content Restrictions: You agree not to upload any User Content that is illegal, infringing, defamatory, obscene, or otherwise objectionable.
    • Moderation: SecondRx reserves the right, but has no obligation, to moderate User Content. We may remove or edit any User Content that violates these Terms.

  10. Intellectual Property

    • The Platform and Services, including all content and materials, are protected by intellectual property laws. All content on the Platform, including text, graphics, logos, and images, is the property of SecondRx or its licensors. You are not granted any license or right to use SecondRx's trademarks or intellectual property without our express written consent.

    • Not for Emergencies: The Platform and Services are not intended for medical emergencies. If you have a medical emergency, please contact your local emergency services immediately.
    • No Liability for Emergencies: SecondRx is not liable for any loss or damage arising from the use of the Platform or Services in an emergency.

  14. Disclaimers of Warranties

    • No Warranties: SecondRx provides the Platform and Services "as is" without any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
    • Accuracy of Information: SecondRx does not warrant the accuracy, completeness, or timeliness of the information on the Platform.
